Public Law/Public Private Partnerships

The Firm has extensive knowledge and experience in public law/public private partnership matters through its work on several PPP transactions, its representation of the High Council for Privatization and PPP - the public entity in charge of all privatization and public private partnerships projects carried out in Lebanon - and through the handling of dozens of files before the State Council.

Selected Matters

  • The Firm represented a company that was awarded a license to produce electricity from wind power in all matters pertaining to the negotiation and execution of the power purchase agreement that was signed with the Government of Lebanon on February 1, 2018 as well as with the internal corporate matters of the company.
  • The Firm represented one of the bidders in the context of the Ministry of Energy and Water’s Distribution Service Provider (DSP) Project in Eléctricité du Liban.
  • The Firm represents one of the bidders that was awarded the DSP contract for the design, implementation, operation, and maintenance of the distribution network and metering services in Lebanon on all its contractual issues with Eléctricité du Liban.
  • The Firm represents a leading postal company in Lebanon that was awarded a concession to operate postal services in Lebanon in all matters relating to its day to day business as well as its relationship with the government of Lebanon.
  • The Firm represents the independent port operator that was awarded a concession for the development and operation of a new container terminal at the Port of Tripoli in Northern Lebanon. The Firm assists it in all aspects of its corporate and commercial transactions as well as with its relationship with the government of Lebanon.
  • The Firm assists an end-to-end engineering infrastructure solutions provider to the telecommunications and power industries across America, Africa, the Middle East and Asia with all legal aspects pertaining to its relationships with the operators as well as with various corporate and commercial matters.

  • Legislative and Regulatory Work

    The Firm has actively participated in the enactment and modernization of numerous Lebanese laws and regulations, such as:

    - The proposed amendment to the Law Governing the Acquisition of Real Estate Properties by Non-Lebanese Nationals;
    - The proposed amendment to the Code of Commerce;
    - The amendment to the Judiciary Law;
    - The proposed amendment to the Code of Civil Procedure; and
    - The Capital Markets Law.

    In addition, Chakib Cortbaoui is the president of the "Committee studying the taxation laws and the anti-money laundering law & terrorism” at the Beirut Bar Association and has actively participated in the preparation of the guidelines regarding the obligations of lawyers in the fight against money laundering and financing of terrorism issued by the Beirut Bar Association on April 20, 2017.

    Further, he has recently been consulted by the Lebanese Petroleum Administration, to review and comment on the proposed petroleum register decree which will keep track of all the data and activities concerning reconnaissance, petroleum rights, operators, area (block) coordinates, mortgaging assignment and forced sale activities involved in the oil and gas industry.
